IMPORTANT: These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Rogue AI Trading Inc. ("Company," "we," "us").
By accessing, purchasing, holding access credentials, tokens, licenses, nodes, or otherwise using the Rogue AI Trading Bot or any related services (collectively, the "Service"), you agree to be bound by these Terms.
If you do not agree, do not access or use the Service.
1. No Investment Advice / No Fiduciary Relationship
The Service is provided for software automation, informational, and educational purposes only.
The Company does not provide investment advice, financial advice, trading advice, or recommendations.
The Company is not a broker, dealer, investment adviser, commodity trading advisor, or fiduciary.
Any trading decisions you make are solely your responsibility.
Cryptocurrency and digital asset trading involves substantial risk, including the possible loss of all capital.
2. Eligibility
By using the Service, you represent and warrant that:
You are at least 18 years old (or the age of majority in your jurisdiction)
You have the legal capacity to enter into this agreement
You are not prohibited from using the Service under applicable laws
You are not located in a jurisdiction where the Service is illegal or restricted
3. Description of the Service
The Service may include, without limitation:
Market data analysis
Signal generation
Automated or semi-automated trading functionality
Software tools, dashboards, APIs, nodes, or token-gated features
The Company does not guarantee:
Profitability
Accuracy
Market performance
Availability or uptime
The Service may be modified, suspended, or discontinued at any time without notice.
4. Assumption of Risk
By using the Service, you expressly acknowledge and agree that:
Markets are volatile and unpredictable
Past performance is not indicative of future results
Software bugs, exploits, delays, or failures may occur
You may lose some or all of the capital you deploy
You assume all risks associated with your use of the Service.
5. No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY
6. Fees, Payments, and No Refunds
6.1 Fees
All fees are disclosed prior to purchase or access. You are responsible for all applicable taxes, network fees, and transaction costs.
6.2 No Refund Policy
ALL SALES ARE FINAL. To the maximum extent permitted by law, no refunds will be provided once access is granted.
This includes, without limitation:
Subscription fees
License fees
Token purchases or transfers
Node access or activation
Unused time or features
6.3 Termination for Cause – No Refund
If your access is terminated due to a violation of these Terms, you are not entitled to any refund, credit, or compensation.
7. User Conduct (Strict)
You agree that you will not, directly or indirectly:
Harass, threaten, defame, or abuse the Company, its founders, employees, contractors, or community members
Make false or misleading statements about the Company or the Service
Engage in coordinated attacks, smear campaigns, or reputational harm
Disrupt or interfere with systems, communications, or operations
Reverse engineer, exploit, probe, or abuse the Service
Use the Service in bad faith or for adversarial purposes
Violation of this section constitutes a material breach of these Terms.
8. Suspension and Termination
The Company reserves the right, in its sole discretion, to:
Suspend or terminate your access immediately
Revoke licenses, credentials, nodes, or access keys
Remove you from any associated communication channels
Termination may occur with or without notice, and without refund, including for:
Harassment or abusive behavior
Conduct harmful to the Company or its leadership
Breach of these Terms
Legal, regulatory, or security risk
9. Tokens, Digital Assets, and Access Rights
If access to the Service involves tokens, digital assets, or blockchain-based credentials:
Tokens are not investments
Tokens confer no ownership, equity, voting, or profit-sharing rights
Token value may fluctuate or become worthless
Tokens and digital assets are non-refundable once transferred
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
THE COMPANY SHALL NOT BE LIABLE FOR TRADING LOSSES, LOST PROFITS, LOST DATA, OR CONSEQUENTIAL DAMAGES
THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES
THE COMPANY’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Company and its officers, members, employees, contractors, and affiliates from any claims, damages, losses, liabilities, and expenses arising from:
Your use or misuse of the Service
Your trading activity
Your violation of these Terms
Your public statements or conduct
12. Intellectual Property
All intellectual property rights in the Service are owned by the Company.
You are granted a revocable, non-transferable, non-exclusive license to use the Service solely in accordance with these Terms.
13. Governing Law and Arbitration
These Terms shall be governed by the laws of your State and/or Country, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, conducted on an individual basis.
CLASS ACTION WAIVER: You waive any right to participate in a class, collective, or representative action.
14. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.
15. Modifications
The Company may modify these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
